Labor Law Reform

Promoting Business Growth

OUR MISSION

The National Builders Party (NBP) believes that a nation’s true development is inseparable from the welfare and dignity of its workforce. As The Gambia continues to grow and modernize, it is critical to establish a fair, clear, and globally aligned labor system that both empowers workers and creates a healthy environment for businesses to thrive.

To achieve this, the NBP will introduce a new Labor Law Reform Bill in the National Assembly aimed at overhauling the country’s outdated labor system and replacing it with a standardized hourly wage employment model that conforms to international labor norms and standards.

OUR PLAN

Key Components of the Labor Law Reform will include:

  1. Introduction of a Standardized Hourly Wage System

The Reform will implement a legal hourly wage framework, replacing inconsistent and often unfair pay practices currently in place. Under the new rule, the NBP will:

  1. Establish a national minimum hourly wage that reflects the cost of living in The Gambia.

  2. Create categories of pay scales based on sector, job complexity and experience level.

  3. Ensure that all workers from retail and service industries to construction and administration are compensated fairly for every hour of labor.

  1. Labor Flexibility regulations for employers with Balanced Worker Protections

The Labor Law will support businesses in hiring and restructuring their workforce and where necessary allow employers to conduct layoffs thus making it easier to hire employees without the burdens of judicial red tape or legal wranglings related to labor rules and regulations.

  1. Rights and Benefits for Employees

The new Law will also guarantee essential workplace rights and protection, including:

  • Access to paid leave (sick days, maternity/paternity leave and vacation days).
  • Protections against workplace discrimination and harassment.
  • Provisions for health and safety in the workplace.
  • Right to breaks during work hours as well as limits on excessive overtime.

  1. Mirror Best Practices from Global Labor Standards

To ensure the new system is effective and progressive, the NBP will consult international labor frameworks, especially those of countries such as the United States, Germany and Nordic countries known for balanced labor laws. Where applicable, best practices will be adapted to the Gambian context.

  1. Creation of a National Labor Standards Authority

A new regulatory body will be created to enforce compliance with the new Labor Law. This body will be granted the power to do the following:

  • Monitor employer practices across sectors.
  • Handle employee grievances through a formal reporting and resolution process.
  • Conduct periodic reviews and propose wage adjustments based on inflation and cost-of-living data.
  • Certify businesses that maintain best labor practices, encouraging ethical employment across industries.

  1. Public Education and Awareness Campaign

To ensure the smooth implementation of these new Labor Laws, the NBP will launch a nationwide education campaign to inform both employers and workers about their rights and responsibilities under the new labor law, how to comply with documentation and reporting requirements as well as where to seek help in case of labor disputes or violations.

IMPORTANCE

Under the leadership of the National Builders Party, The Gambia will establish a labor system that respects the dignity of work, promotes productivity and enables fair opportunity for all. By combining international labor standards with locally relevant practices, we will create a sustainable job market that attracts investment, encourages entrepreneurship and builds a strong, secure middle class.
